You know I have heard that as well. But have also known people who have a mod on their console and it still connects and works with xbox live, so I have to go with what I have seen.

Going online with a Mod in your Xbox works, but if Xbox Live detects that you are using a mod, you will be banned from online, so I suggest not even to risk it.
